Litigations against Selection Procedure in UPSC
Jai Prakash Will the Minister of PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS be pleased to state:-
(a) whether it is a fact that there is a plethora of litigations against the selection procedure of the Public Service Commission and Union Public Service Commission in various High Courts and Supreme Court of the country and if so, the details thereof;
(b) whether it is also a fact that despite being an autonomous institution the Public Service Commission is not able to keep pace with new demands like any other Government organisation;
(c) if so, whether the Government propose to improve the functioning of Public Service Commissions to overcome such a situation and to make the good governance stronger in the country; and
(d) if so, the details thereof, if not, the reasons therefor?
ANSWER
MINISTER OF STATE IN THE MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS AND MINISTER OF STATE IN THE PRIME MINISTER’S OFFICE (DR. JITENDRA SINGH)
(a) to (d): Union Public Service Commission (UPSC) and the State Public Service Commissions are constitutional bodies set up under Article 315 of the Constitution of India. UPSC has informed that it selects candidates for Government jobs by the following four categories:
i. Competitive Examination
ii. Direct Recruitment by Selection
iii. Promotion and Deputation
iv. Induction into All India Services (IAS, IPS and IFoS)
Selection of the candidates by UPSC is made as per relevant rules and instructions issued by the Government. As in most cases, number of candidates is very large against limited vacancies, and some of the candidates, who are not selected, go to courts for redressal of their grievances. As regards State Public Service Commissions, no centralized data is maintained by the Central Government.
